A tax return is a formal declaration whose accuracy the company is responsible for, and it cannot be corrected after submission except through a defined statutory route. So we treat the return as the output of a review process rather than a form filled in on the last day: we review the books, verify the treatment, then file.

Regulatory framework

A tax return is filed for each tax period within the deadline set by the applicable legislation, and late filing or late payment attracts administrative penalties determined by the competent authority. Tax periods differ between businesses, so the calendar follows what is recorded in your file with the Authority.

A return that is one day late is a late return. The deadline is not measured by intent.

Who carries responsibility for an error in the return?

Statutory responsibility for the accuracy of the data provided to us remains with the taxable person, and we carry responsibility for the soundness of the tax treatment of what we prepare and file as tax agent.

We have found an error in an earlier return. What do we do?

Do not leave it. We assess its impact and file through the statutory route to correct it. Coming forward is a better position than leaving an error to be discovered.

Do we need properly kept books to file a return?

In practice, yes. A return can be prepared from scattered documents, but it takes longer, raises the chance of error, and leaves you without organised support in any review.
